Description : Four years ago I gifted my horse, Avery, a highly bred registered Belgian Warm Blood, to another Parelli student, thinking she would benefit from having a horse she could do dressage with and that it would also benefit Avery to do what he was bred to do (dressage), as I had no intention of "showing" him. In our written agreement, I wanted to make sure she would not turn around some day and sell him since he was free. I said he had to come back to me once she was done using him. Furthermore, to keep him out of anyone else's hands if something should happen to the other party, I was retaining 10% ownership with right of survivorship. We both signed. Last summer, days before we were moving across the country, she sent me a FB message saying she can no longer afford to keep Avery, can I take him or do I know of someone who could? With only days left to go before our move cross country, I now think she was planning that I would not be in a position to take him to AZ - that she was trying to get me to "refuse" to take him with me that then she felt she had lived up to her end of the agreement by offering him (when she knew I couldn't take him, thereby letting her out of her side of the contract. Without any warning or explanation, as we were making final arrangements to get Avery, she completely stopped answering her phone and messages from me. Last week (May 2013) I saw online that a draft dealer in Ionia, MI, had published videos of a new horse - my WB Avery - at their facility. I also saw on the girl's public page that she had gotten a new horse, one from the same draft horse dealer. I called the dealer and was told they had Avery. When I talked to the draft dealer they said they had moved Avery out of state to get training and to sell him. I asked them if they were aware of my contract and they said they were not.
